Westside lawyers successfully defended the interests of “LG Electronics RUS” LLC in a dispute with a counterparty under an international supply contract

Westside lawyers successfully defended the interests of "LG Electronics RUS" LLC (Respondent) in a dispute with a counterparty, which was considered at the International Commercial Arbitration Court at the Chamber of Commerce and Industry of the Russian Federation.

The purchaser under the international supply contract, filed a lawsuit against "LG Electronics RUS" LLC on recovery more than 20 million rubles for not-delivering a lot of smartphones. The plaintiff pointed out that the lot of the paid goods did not reach his warehouse because LG Electronics Rus LLC transferred  goods destined for the Claimant to an unidentified person. The position of "LG Electronics RUS" LLC was represented by Westside: partner Yegor Kravchenko and associate Mikhail Usikov.

The Board of Arbitrators of the ICAC at the Chamber of Commerce and Industry of the Russian Federation accepted the position of the Respondent and dismissed the claim in full, indicating in the decision that "LG Electronics RUS" LLC acted reasonably and in good faith and fulfilled its obligations to the Claimant for the delivery of the goods, and the Claimant in its turn did not exercise due to diligence in choosing the freight forwarder and the carrier, who accompanied and carried out the transportation of the goods in the dispute.
